Abstract

Habitus, Code and Codification.Though it is precisely the vocation of sociology to point out that, in Montesquieu's phrase, «society is not changed by decree», the fact remains that awareness of the social conditions of the efficacy of juridical acts must not lead one to ignore or deny that which makes the specific efficacy of rules, regulations and laws. The justified reaction against juridism which makes it possible to restore their rightful place, in explaining practices, to the dispositions constituting the habitus, in non way implies that one should bracket off the intrinsic effect of an explicitly stated rule, especially when, like the juridical rule, it isassociated with sanctions. Conversely, while there is no doubt that law exerts a specific efficacy, attributable in particular to the work of codification, structured formulation, neutralization and systematization, which the professionals of symbolic work carry out in accordance with the specific laws of their universe, it is nonetheless the case that this efficacy, which is defined by opposition to pure and simple non-application or to application based on pure constraint, works only to the extent that law is socially recognized and meets a demand, albeit tacit and partial, because it corresponds, at least apparently, to real needs and interests.Habitus, code et codification.S'il est de la vocation même de la sociologie de rappeler que, selon le mot de Montesquieu, on ne transforme pas la société par décret, il reste que la conscience des conditions sociales de l'efficacité des actes juridiques ne doit pas conduire à ignorer ou à nier ce qui fait l'efficacité propre de la règle, du règlement et de la loi. La juste réaction contre le juridisme, qui conduit à restituer leur place, dans l'explication des pratiques, aux dispositions constitutives de l'habitus, n'implique nullement que l'on mette entre parenthèses l'effet propre de la règle explicitement énoncée, surtout lorsque, comme la règle juridique, elle est associée à des sanctions. Et inversement, s'il n'est pas douteux que le droit exerce une efficacité spécifique, imputable notamment au travail de codification, de mise en forme et en formule, de neutralisation et de systématisation, que réalisent, selon les lois propres de leur univers, les professionnels du travail symbolique, il reste que cette efficacité, qui se définit par opposition à l'inapplication pure et simple ou à l'application fondée sur la contrainte pure, s'exerce dans la mesure et dans la mesure seulement où le droit est socialement reconnu, et rencontre un accord, même tacite et partiel, parce qu'il répond, au moins en apparence, à des besoins et des intérêts réels.Habitus, Rechtskode und Kodifizierung.Ist die Soziologie geradezu berufen, daran zu erinnern, daß die Gesellschaft, einem Ausspruch von Montesquieu zufolge, nicht per Dekret verändert wird, so darf doch das Wissen um die gesellschaftlichen Bedingungen der Wirksamkeit von Rechtsakten weder zur Ignorierung noch zur Leugnung der spezifîschen Wirksamkeit von Regel, Regelung und Gesetz führen. Die richtige Reaktion auf den Rechtsformalismus, die den konstitutiven Dispositionen des Habitus ihren Platz in der Erklärung der Praktiken wieder einräumt, impliziert keineswegs die Ausklammerung des eingentumlichen Effekts der explizit formulierten Regel, nicht zuletzt wenn sie, wie die juristische, mit Sanktionen einhergeht. Und wenn umgekehrt nicht aufier Zweifel steht, daß das Recht insbesondere aufgrund der Kodifizierung, der Formung und Formulierung, der Neutralisierung und Systematisierung, welche die Professionellen der symbolischen Arbeit gemäß den eigentümlichen Gesetzen ihres Universums ausführen, eine spezifische Wirkung ausübt, so vollzieht sich diese Wirkung, die sich im Gegensatz zur blofeen Nichtanwendung oder der auf reinem Zwang begründeten An-wendung defîniert, in dem und nur in dem Maße, wie das Recht gesellschaftlich anerkannt wird und auf eine wie immer stillschweigende und partielle Zustimmung deshalb trifft, weil es zumindest dem Anschein nach wirklichen Bedurfnissen und Interessen entspricht.
