The General Election Commission (KPU) is a state institution recognized by the constitution as stated in the 1945 Constitution Article 22E paragraph (5) which reads "General elections are held by an election commission that is national, permanent and independent". Through the Decision of the Constitutional Court Number 04/PUU-VII/2009 this gives legal status to ex-convicts to take part in general elections, both legislative elections at the Provincial and Regency/City levels with the condition that ex-convicts who openly and honestly state this to the public are excluded. that the person concerned is a former convict. The research method used is normative jurisdictional research method. Normative research requires a statutory approach and a conceptual approach. The data collection technique used was through document and literature studies on secondary data in the form of primary, secondary and tertiary legal materials. In conclusion, it was found that the status of former convicts who will take part in legislative elections has been guaranteed since the decision of the Constitutional Court was issued in line with Law Number 7 of 2017 concerning general elections.
