Abstract

We theorize the past as a fluid resource that is interpreted in the present. This theory is augmented with a case-study of an essential U.S. institution (constitutional law) and the organization that embodies it (the Supreme Court). In conclusion, we assert that institutional maintenance, as currently theorized, is a myth.
