Abstract

This article deals with the human right to water and sanitation in the international, comparative, and national law. It maintains that this fundamental right is implicit in the International Charter of Human Rights, besides being considered in international treaties and declarations. It points out that several constitutions recognized this right, either expressly or tacitly, apart from judicial decisions that invoked it to protect other human rights in those legal systems. Finally, it maintains that this is a fundamental right in the Chilean legal system and that there are some judicial decisions that recognized it for different objectives.
