Abstract
This article brings a reflection on the evolution of the principle of legality to the principle of juridicity and its reflexes on the discretion in the exercise of the administrative function from the constitutionalization of Administrative Law. The work also discusses the (im)possibility of judicial control of the merits of administrative acts and their impacts on the guarantee of social rights.
