Abstract

The purpose of this article is to examine the legal situation of the surviving cohabitant in the absence of a declaration of the common-law relationship. This is due to the fact that the Civil Code does not recognize the surviving cohabitant as a successor. Therefore, the objective was to determine if there is a rule within the Ecuadorian legislation that regulates the process of intestate succession and guarantees the right of succession to the surviving cohabitant. For the correct development of this study, a qualitative research methodological approach has been applied, since it is essential to apply the analytical-synthetic and inductive methods that allow the analysis and understanding of issues and problems of these characteristics. At the end of the research, it is concluded that the surviving cohabitants will only be able to enjoy their rights, including those of inheritance, through the common-law union regulation, however, there are great legal gaps in the Ecuadorian norm, so that the violation of the right to inheritance recognized by the Constitution of the Republic of Ecuador has been proven.El presente artículo científico persigue investigar la situación legal del conviviente supérstite frente a la falta de declaración de la Unión de Hecho. Esto, en razón de que en el Código Civil no se reconoce como llamado a suceder al conviviente sobreviviente. Por lo que, se planteó como objetivo identificar si existe una norma dentro de la legislación ecuatoriana que regule el proceso de sucesión intestada y garantice el derecho de suceder al conviviente sobreviviente. Para el correcto desarrollo de este estudio se ha aplicado un enfoque metodológico de investigación de carácter cualitativo ya que es vital aplicar los métodos analítico- sintético y el inductivo que permiten analizar y comprender cuestiones y problemas de estas características. Una vez terminada la investigación se concluye que los convivientes sobrevivientes únicamente podrán gozar de sus derechos incluidos los de sucesión a través de la regulación de Unión de Hecho, no obstante, existen grandes vacíos legales en la norma ecuatoriana, de forma que se ha evidenciado la vulneración al derecho de sucesión que reconoce la Constitución de la República del Ecuador.
