O DESENVOLVIMENTO DAS SOFT SKILLS PELO PROFISSIONAL DA ADVOCACIA PARA APLICAÇÃO NOS MÉTODOS ALTERNATIVOS DE RESOLUÇÃO DE LITÍGIOS

Abstract

The present work seeks to expose the need for constant evolution of the legal professional, not only as to the pure and simple knowledge of the legislation. It is not enough to just develop hard skills, which are those specific and determinable skills that can be learned and developed in courses, degrees and specializations. It appears, therefore, that special attention is needed regarding the incorporation and improvement of soft skills: a set of interpersonal skills and competencies related to human behavior and emotional intelligence, which can help not only improve the client-lawyer relationship , but increase the productivity of a team, make the work environment light, thus enabling the emergence of creative, sustainable solutions that can specifically influence the success of using alternative methods of conflict resolution, namely: negotiation, conciliation , mediation and arbitration.O presente trabalho procura expor a necessidade de evolução constante do profissional de advocacia, não só quanto ao conhecimento puro e simples da legislação. Não basta apenas desenvolver as hard skills, que são aquelas habilidades específicas e determináveis que podem ser aprendidas e desenvolvidas em cursos, graduações e especializações. É preciso especial atenção quanto à incorporação e aprimoramento das soft skills: um conjunto de habilidades interpessoais e de competências relacionadas ao comportamento humano e à inteligência emocional, e que podem auxiliar não só a melhoria da relação cliente-advogado, mas aumentar a produtividade de uma equipe, tornar leve o ambiente de trabalho, possibilitando, assim, o surgimento de soluções criativas, sustentáveis e que podem influenciar especificamente no sucesso da utilização dos métodos alternativos de resolução de conflitos, quais sejam: negociação, conciliação, mediação e arbitragem.
