This paper discusses a recent Supreme Court ruling regarding the applicability of the consultation recognized in the ILO Convention No. 169, regarding those investment projects which are assess within the Environmental Impact Assessment System. The center of the analysis lies in the new standards that the Court uses to judge the validity of this mechanism of participation, such as the reasonableness and proportionality.
