The clear language and transparency of judicial decisions

Abstract

The purpose of this article is to analyze the quality of the rulings handled by the members of the legal community of the Peruvian Judicial Branch, the right to understand, and institutional transparency. With this objective, we seek the reception of a methodological regulation that allows obtaining judicial resolutions written in clear language for the citizen reader, to generate greater transparency and institutional legitimacy. This text is supported by doctoral legal research of a quantitative and applied nature, based on the hypothetical-deductive method. In order to fulfill the proposed purpose, the population of lawyers working in the Judicial Branch was analyzed using a non-probabilistic and intentional sampling of 30 subjects. The conclusion obtained is that the perception on the improvement of the quality of the judgments of the Peruvian Judiciary must be given with a methodological regulation of clear language to overcome this communication barrier that affects the transparency and legitimacy of this power of the State and the right to an understanding of the citizens who have access to justice in Peru.
