Abstract

It  is very timely to start talking about poverty in Latin America that has been maintained for several years according to the ECLAC report (2019b) in 2017, an estimated 184 million (30.2% of the population) continue to live in poverty , of that amount a total of 62 million were in extreme poverty (10.2% of the population, the highest percentage since 2008) (ECLAC, 2019a), the region is still characterized by a very unequal distribution of income by This reason today focuses more studies for the inclusion of the poorest and most vulnerable population to social protection systems (Naranjo, 2013). Social protection has emerged in recent years as an important axis that integrates measures aimed at building fairer and more inclusive societies and guaranteeing minimum living standards for all. The responsibility for guaranteeing these rights rests primarily with the State that plays an important role in social protection (Naranjo, 2013). For this reason, this research has been developed, which is closely linked to the labor sector and is one of the main debates currently being held between the social security authorities and society, as is the case of the Retirement. Social security is a topic of great importance not only for Ecuador, but also for democratic nations through it, it seeks to reduce the vulnerabilities our society faces and with greater emphasis on the extreme poverty sector (Sasso, 2001) . With regard to Retirement, it can be manifested as a particularly social benefit, it is a life pension to which the worker and / or employer is entitled, as the case may be, after having worked certain years, one could say that it is the You have the right to enjoy after having accumulated many years of service. In Ecuador, the private employer has developed a social legal protection system for these cases. The legislator has sought to establish the equality of retirement between the one granted to date by Social Security and the one to be granted by the Employer Party, at least in terms of service times (Pineda Llanes, 2016).  As this topic is of great importance, this work is carried out with the purpose of acquiring new knowledge, which allows conceptualizing and expressing in the recommendations the different applications that are in force in our country, which allow us to establish whether retirement is a right that the worker has for having rendered his services for the development of the country, or simply is a way of benefit that the IESS does, under the principle of solidarity, which is aimed at supporting those who place their economic resources in a condition of inferiority compared to the rest of the population (Sánchez Vera, 2018).
