STRICT LIABILITY AND PRODUCT SAFETY: THE CASE OF DANGEROUS SYRUP IN INDONESIA IN THE MAQĀṢID AL-SHARĪ’AH PERSPECTIVE

Abstract

Indonesia faces serious challenges in preventing side effects from drugs containing dangerous chemicals. This study examines the case of cough syrup, which has been linked to child deaths in Indonesia. This qualitative research comes from document studies, news reports and official statements from related parties using the maqāṣid al-sharī'ah approach and strict liability theory. This study indicates that applying the principle of strict liability ensures that manufacturers are legally responsible for the quality and safety of products that prioritize consumer safety, especially for children vulnerable to dangerous products. Integrating strict liability and the principles of maqāṣid al-sharī'ah encourages preventive action to protect society from the negative impacts of dangerous products. In addition, food and drug control requires a legal framework that is more comprehensive and oriented towards health and consumer protection. This is done to explore a holistic and ethical view of Islamic law and contribute positively to creating a safer environment and protecting society.
