Abstract

The financing of ventures, in all its figures, constitutes a topic of boom connoted in contemporary legal realities. This subject, marked by its location halfway between Economic Sciences and Law, constitutes one of the pillars of success or failure in these experiences. In the Cuban scenario, it is one of the most important variables since its adequate regulation is transcendent in the management and performance of these figures, who need sources of financial coverage to undertake the enterprise itself or the investments for the development of the fundamental activity to carry out or rearrange it for export. Under this imperative, legal advice faces enormous challenges. It is not about the traditional marking of the legal route or traditional advisoring, it is about the coverage of risks in an obligatory process with distinctive elements and with burdensome effects for the already vulnerable figure of micro, small and medium-sized companies in Cuba. The objective of this work is to establish the guidelines for legal advice in the process of financial leverage of these figures in the Cuban scenario.
