Psychological analysis and application of litigation process considering judicial justice

Abstract

Judicial justice is fundamental to social stability and the rule of law, and directly depends on the fairness of the litigation process. Drawing on the theory of cognitive psychology, this paper explores the social identity of judges considering judicial justice, and analyzes the psychology of judges in the process of litigation through a questionnaire survey. The results show that judicature is the core of the legal system, and judicial justice is the goal of socialjustice; In the trial stage, the judges' psychology is featured by strong independence, followed by good judgment and objective psychological behavior; In the process of litigation, the psychological performance of judges hinges on gender, judge rank and the type of cases. This research lays the theoretical basis for the application of psychology in the judicial process, which will greatly improve judicial impartiality.
