HAMBATAN-HAMBATAN YANG MUNCUL DALAM IMPLEMENTASI HAK-HAK ANAK DALAM PROSES PEMERIKSAAN PERKARA DI TINGKAT PENYIDIKAN

Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui hambatan dalam implementasi pemenuhan hak-hak tersangka anak dalam perkara No Pol. : 19/Pid.Sus.Anak/2016/PN Mkd. Penelitian ini dilihat dari tujuannya termasuk jenis penelitian hukum empiris bersifat yuridis sosiologis dengan menggunakan metode kualitatif. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder yang menggunakan studi lapangan untuk teknik pengumpulan bahan hukum Hasil penelitian menunjukkan bahwa hambatan-hambatan yang dijumpai dalam proses penangkapan sampai dengan proses penahanan dalam rangka implementasi hak-hak tersangka ditingkat penyidikan adalah jangka waktu yang singkat, proses visum untuk pembuktian terjadinya perbuatan tindak pidana membutuhkan waktu yang tidak sebentar, minim perlindungan terhadap pelaku anak, ruangan pemeriksaan khusus untuk anak yang masih terbatas, ketidaktahuan tersangka akan hak-hak yang dimiliki, tersangka dalam memberikan keterangan juga berbelit-belit dan tersangka tidak kooperatif, kurangnya pengetahuan Tersangka Anak akan pentingnya bantuan hukum yaitu dengan didampingi oleh Penasehat Hukum selama proses pemeriksaannya.
