PERALIHAN AGAMA SEBELUM PEMBAGIAN WARISAN MENURUT IBNU TAIMIYAH

Abstract

The Islamic inheritance law established that the inheritance is devided to heirs (al-wâris) after the owner’s (almuwarris) died. This division should be done immediately after the obligations associated with obtaining a death and property were paid. In the reality, inheritance is often not divided immediately, so thet giving rise to other legal consequences for heirs. For example is the change of religion of heirs. In the Islamic heritance law, religious diference is the barrier to receiving inheritance. Ibn Taimiyya argued, that the religion of heirs is the religion when the inheritance divided, and not when the owner’s (al-muwarris) died.[Hukum waris Islam menetapkan bahwa harta warisan dibagikan setelah pewaris meninggal dunia dan segera mungkin dibagi kepada ahli waris (al-wâris). Namun dalam realitas kehidupan umat Islam sering terjadi harta warisan tidak dibagi dengan segera sehingga dapat menimbulkan akibat hukum lain bagiahli waris. Sebagai contoh terjadinya perubahan agama ahli waris sebelum terjadinya pembagian waris. Dalam hukum waris Islam perbedaan agama antara pewaris dengan ahli waris merupakan penghalang terjadinya kewarisan. Ibnu Taimiyah berpendapat, bahwa agama yang menjadi pegangan dalam pembagianwarisan adalah agama yang dianut ketika pembagian warisan, dan bukan ketika pewaris (al-muwarris) meninggal dunia.]
