PERBANDINGAN PENGATURAN TINDAK PIDANA PENODAAN AGAMA MENURUT KUHP INDONESIA DAN ISRAEL PENAL LAW 5737-1977

Abstract

This legal writing aims to find out the comparison of the regulation of the Criminal Acts of Blasphemy based on the Indonesian Criminal Code and the Israeli Penal Law 5737-1977. The comparison includes differences, similarities, and advantages and disadvantages of each legislation. This legal writing belongs to the category of normative legal writing with a prescriptive and applied nature through a comparative approach. The sources of legal materials used in this research are primary and secondary legal materials. Data collection techniques were carried out through library research and data analysis used, namely the syllogism method through a deductive approach. Based on the comparison of the regulation of the crime of blasphemy based on the Indonesian Criminal Code and the Israeli Penal Law 5737-1977, there are several similarities and differences. Through these similarities and differences, it can be seen the advantages and disadvantages of each arrangement, both from the Indonesian Criminal Code and from the Israeli Penal Law 5737-1977. So from this comparison, it can be found several advantages of the Israeli Penal Law 5737-1977 Regulations on the Crime of Blasphemy of Religion in Israel which can be input for updating the Indonesian Criminal Code regulations on the Crime of blasphemy in Indonesia, so that regulatory aspects related to the Crime of Blasphemy in Indonesia will going better.
