Aportaciones fragmentarias a la representación política del Tribunal Constitucional español y del Tribunal Europeo de Derechos Humanos: una teoría liberal-democrática

Abstract

Welches sind die Unterschiede zwischen den verschiedenen Arten von Globalisierung? Die Globalisierung über die Grundrechte besitzt eigene Wesenszüge. Welches ist die verschiedenartige Relevanz des Rechts in der Logik der Märkte, im Europarat, im System der Europäischen Menschenrechtskonvention, im interamerikanischen System und in der Europäischen Union? Nur im dritten Bereich gibt es eine direkte politische Vertretung im Europaparlament und eine Staatenvertretung in der EU-Kommission sowie im Europarat, einer doppelten Legitimität folgend. Aber es ist noch viel zu tun, was die politische Repräsentanz innerhalb der EU und mehr noch in den einzelnen Mitgliedsstaaten betrifft. Hierzu sind Veränderungen in den Bestimmungen und in der politischen Kultur notwendig. Soweit wie heute möglich habe ich hier nun einzelne Grundelemente der liberalen, demokratischen Theorie der politischen Vertretung genannt, die sich aus der Rechtsprechung des Verfassungsgerichts und des Europäischen Gerichtshofs für Menschenrechte ergeben.Which are the differences among the different types of globalización? Globalization through fundamental rights has its own features. What is the scope of law within the logic of markets, at the European Council and the system of European Convention of Human Rights as well as the interamerican system or in the EU? It is only in the third field that a direct political representation at EU Parliament and a representation of States at the Commision and European Council according to a dual legitimacy exists. There is still great work to be done in the EU regarding political representation, and even more within the EU members. Certain changes in the laws and political culture are required. Just in case, here I have predicted some basic ingredients of liberal and democratic theories of political representation which derives from case law coming from the Constitutional Court and the European Court of Human Rights.¿Cuáles son las diferencias entre los distintos tipos de globalización? La globalización a través de derechos fundamentales tiene rasgos propios. ¿Cuál es la diversa relevancia del Derecho en la lógica de los mercados, en el Consejo de Europa y el sistema del Convenio Europeo de Derechos Humanos y el sistema interamericano, y en la Unión Europea? Solo en el tercer espacio existe realmente una representación política directa en el Parlamento Europeo y una representación de los Estados en la Comisión y el Consejo Europeo siguiendo una legitimidad dual. Pero es mucho lo que queda por hacer en la Unión en la representación política y aún más en los Estados miembros. Son precisos cambios en las normas y en la cultura política. Por si el tiempo llegara, he singularizado algunos ingredientes básicos de la teoría liberal y democrática de la representación política que se desprende de la jurisprudencia del Tribunal Constitucional y del Tribunal Europeo de Derechos Humanos.
