Desafíos para el ordenamiento jurídico chileno ante el crecimiento sostenido de los flujos migratorios

Abstract

The present paper criticizes some characteristic elements of the chilean immigration law, specifically those related to its fundaments and to the protection of immigrant’s fundamental rights. Given an increasing immigration movements, resents decisions are analyzed, from Constitutional and Supreme Court, as well as the project of a new immigration law, in current discussion at the National Congress. Assuming the critiques observations made by international organisms, the paper propose an integral revision of the immigrant legal statute.
