OS IMPACTOS DA UTILIZAÇÃO DA INTELIGÊNCIA ARTIFICIAL NO PROCESSO PENAL: DESAFIOS ÉTICOS A SEGURANÇA JURÍDICA DAS GARANTIAS FUNDAMENTAIS DO RÉU

Abstract

O presente trabalho analisa o uso da Inteligência Artificial no Sistema de Justiça Penal brasileiro, investigando em que medida sua aplicação pode comprometer a segurança jurídica e as garantias fundamentais do réu. Parte-se do problema de pesquisa que questiona até que ponto essa tecnologia afeta princípios essenciais do devido processo legal, considerando a hipótese de que sua implementação, sem controle adequado, pode gerar decisões parciais, erros técnicos e violações de direitos fundamentais. O objetivo geral consiste em compreender os impactos éticos e jurídicos decorrentes da adoção da Inteligência Artificial no processo penal, destacando seus riscos, limites e desafios. Metodologicamente, a pesquisa utiliza abordagem qualitativa e exploratória, com base em revisão bibliográfica, análise jurisprudencial e estudo de documentos normativos. Os resultados indicam que, embora a Inteligência Artificial ofereça potencial para aprimorar a eficiência judicial, sua aplicação sem diretrizes claras e fiscalização adequada pode ameaçar a imparcialidade e a proteção dos direitos humanos.The present work analyzes the use of Artificial Intelligence in the Brazilian Criminal Justice System, investigating to what extent its application can compromise legal certainty and the fundamental guaranties of the defendant. The research problem questions to what extent this technology affects essential principles of due process, considering the hypothesis that its implementation, without adequate control, can lead to biased decisions, technical errors, and violations of fundamental rights. The general objective is to understand the ethical and legal impacts resulting from the adoption of Artificial Intelligence in criminal proceedings, highlighting its risks, limits, and challenges. Methodologically, the research employs a qualitative and exploratory approach, based on bibliographic review, jurisprudential analysis, and the study of normative documents. The results indicate that, although Artificial Intelligence offers potential to enhance judicial efficiency, its application without clear guidelines and adequate  oversight can threaten impartiality and the protection of human rights.
