Intersex people, those who have sexual characteristics of both sexes, whether chromosomal, gonadal or genital, seriously question sexual binarism. The wide ignorance of their reality has often been accompanied by a deep-rooted social prejudice, which has motivated, among other things, that for a long time, and even today, many of them have undergone sex “assignment” surgeries; that have caused them serious physical and psychological damage. This paper intends to carry out an eminently legal approach to the status of intersex people from a human and fundamental rights perspective, focusing on their recognition at the international level (UN, Council of Europe and European Union), as well as in the guarantees that Spanish legal system offers for this purpose.
