Tinjauan Yuridis terhadap Peran Mediasi dalam Mengurangi Tumpukan Kasus Perceraian di Pengadilan Agama (Studi Kasus di Pengadilan Agama Kelas 1A Metro

Abstract

The high divorce rate handled by Religious Courts in Indonesia has become a serious problem in the religious justice system, especially related to the backlog of cases that has an impact on the slow legal process. Mediation is expected to be an effective alternative solution in reducing the number of divorce cases, but its effectiveness is still questionable. This study aims to evaluate the role of mediation in reducing the backlog of divorce cases in the Class 1A Metro Religious Court. Using a qualitative approach and case study method, data was collected through in-depth interviews and documentation studies, then analyzed thematically. The results of the study indicate that mediation has a positive contribution, with a success rate of around 60% in resolving cases before trial. The success of mediation is influenced by the readiness of the parties to the case, the competence of the mediator, and attendance at the mediation session. This study contributes to the development of mediation practices in Islamic family law, while highlighting the need for mediator training and increasing awareness of the parties regarding the importance of mediation. The implications of this study include the need for mediation policy reform and stronger systemic support in religious courts. Suggestions for further research include exploring strategies for optimizing the role of mediators and mediation approaches based on local culture.
