Prostitution and criminal law

Abstract

The article provides an overview of the criminal provisions concerning prostitution. In contrast to the so-called “Nordic model”, the demand for and the milieu of prostitution are not fullyy criminalised in Germany. Instead, criminal law regulation is oriented towards the fundamental acceptance of prostitution practised on one’s own responsibility. In short: It is not about protection against prostitution, but about protection in prostitution. Nevertheless, a systematically coherent overall concept is still missing. Finally, the need for reform is pointed out.
