The purpose of this research is to analyze what principles and responsibilities are ideal for Ship Owner when Passengers, Third Parties as Charterers and Ship Crew suffer losses when the operated ship experiences a vessel flooding. First, the transportation entrepreneur as the owner of the ship actually maintenance his ship on a regular basis based on the prevailing laws and regulations. Second, as a Passenger when experiencing a loss with the Transportation Entrepreneur, he can take legal action together (Class Action) with other passengers who are victims by filing a lawsuit with the BPSK (Consumer Dispute Resolution Agency) at the consumer's domicile. Meanwhile, third parties as ship charterers must pay attention to the Choice of Law and Choice of Forum which are used and agreed upon when the parties experience a dispute.
