OPTIMALISASI MEDIASI SEBAGAI MEKANISME PENYELESAIAN KONFLIK KEKERASAN DALAM RUMAH TANGGA

Abstract

Domestic violence is a complex social issue with profound impacts, particularly on women and children. The criminal justice system is often considered inadequate in providing satisfying resolutions for all parties, especially in emotionally-bound and continuous family relationships. Mediation emerges as an alternative dispute resolution mechanism that focuses on restoring relationships and achieving peaceful settlements. This study aims to analyze the extent to which mediation can be optimized in resolving domestic violence cases, as well as to examine its effectiveness, challenges, and development potential in Indonesia. The research uses a normative juridical approach with qualitative data analysis. The findings indicate that mediation has significant potential in resolving domestic violence conflicts in a humane manner, but it requires strong regulatory support, professional mediator training, and maximum protection for victims. Optimizing mediation can serve as an alternative solution that balances justice and family harmony.
