¿Mandato de resocialización o derecho fundamental a la resocialización? Una lectura crítica de la jurisprudencia constitucional

Abstract

The resocialization mandate included in article 25.2 of the Spanish Constitution is currently a very debated constitutional principle, at the same time that it is little understood by a large part of the citizenry. This study tries, on the one hand, to emphasize the broad scope of application of the mandate, usually identified with the prison treatment, but which actually concerns all stages placed between the configuration of the sentence and the publicity of criminal records, and also, this investigation tires to critically and exhaustively analyze constitutional jurisprudence that does not consider resocialization as the content of a fundamental right.El mandato de resocialización recogido en el artículo 25.2 de la Constitución Española es en la actualidad un principio constitucional muy debatido a la par que poco comprendido por buena parte de la ciudadanía. Esta investigación trata, por un parte, de enfatizar el amplio campo de aplicación del mandato, usualmente identificado con el tratamiento penitenciario, pero que concierne a todas las etapas comprendidas entre la configuración de la pena y la publicidad de los antecedentes penales, y, por otra, de analizar crítica y exhaustivamente la jurisprudencia constitucional que no considera la resocialización como contenido de un derecho fundamental.
