POLITIK HUKUM PEMBENTUKAN DESA MENURUT UNDANG UNDANG NOMOR 6 TAHUN 2014 TENTANG DESA

Abstract

This study aims to find a comparison of the legal politic in establishment of village according to Act Number. 6 year 2014 by and Act Number 32 year 2004 and the establishment mechanism of village according to those regulations. This research is a normative one with legislative approach, conceptual approach, historical approach and comparative approach. Based on result of this research can be concluded that; (1) legal politic of Act Number 6 Year 2014 in proposal mechanism on establishment of village is more restrictive than Act Number 32 year 2004; (2) There are difference in proposal mechanism on establishment of village in Act Number 6 Year 2014 and Act Number 32 year 2004, namely: proposal initiator of village establishment; involvement of governor in proposal of village establishment; and nature of mechanism of village establishment.
