AKIBAT HUKUM PARA TERDAKWA YANG TIDAK DIDAMPINGI PENASEHAT HUKUM DALAM PERKARA TINDAK PIDANA KEHUTANAN

Abstract

ABSTRAK Penelitian Hukum ini bertujuan untuk mengetahui akibat hukum Para Terdakwa yang tidak didampingi Penasehat Hukum dalam suatu perkara tindak pidana, dalam penelitian ini yaitu tindak pidana kehutanan. Metode penelitian yang dipergunakan diantaranya: jenis penelitian hukum normatif atau doctrinal research, bersifat perskriptif, dan pendekatan kasus. Berdasarkan ketentuan Pasal 56 Kitab Undang-Undang Hukum Pidana (KUHAP) mengatur bahwa seharusnya Para Terdakwa memenuhi unsur untuk mendapat pendampingan dari Penasehat Hukum yang ditunjuk oleh penyidik secara cuma-cuma atau gratis. Kenyataan yang terjadi dalam kasus ini Para Terdakwa tidak didampingi Penasehat Hukum dari proses penyidikan hingga proses persidangan. Hal ini bertentangan dengan Pasal 56 KUHAP. Sesuai dengan peraturan yang berlaku seharusnya Para Terdakwa dibebaskan karena semua produk hukum yang dihasilkan oleh Para Terdakwa cacat hukum dan tidak dapat diterima. ABSTRACT This Legal Research aims to find out the legal consequences of the Defendants who were not accompanied by a Legal Advisor in a criminal case, in this research is the forestry crime. The research methods used include: types of normative or doctrinal research, descriptive, and case approaches. Based on the provisions of Article 56 of the Criminal Procedure Code, it stipulates that the Defendants should fulfill the element to receive assistance from the Legal Advisor appointed by the investigator for free. The fact that happened in this case was that the Defendants were not accompanied by a Legal Advisor from the investigation process to the trial process. This is contrary to Article 56 of the Criminal Procedure Code. In accordance with applicable regulations, the Defendants should be released because all legal products produced by the Defendants are legally defective and unacceptable.
