Abstract

An investigation is a series of investigative actions at a time regulated in accordance with the procedures contained in the law. The party conducting the investigation is the police. A child who is revealed to have experienced a crime in the form of obscenity then the child must be protected and examined by the Police as a state apparatus as regulated in Law Number 35 of 2014 concerning Child Protection. This study will discuss the process of investigating cases of child abuse and its analysis of the process of investigating cases of child abuse when viewed from the perspective of child protection law with data obtained from the East Java Regional Police. This study uses the juridical-empirical method by conducting interviews with East Java Police investigators who handle cases of child abuse. The results of this study indicate that the procedures given by the East Java Regional Police in conducting investigations into children as victims of sexual abuse are in accordance with providing facilities and physical or psychological recovery due to working with psychiatric institutions and hospitals in Surabaya so that children who have become victims of sexual abuse get their right to protected as a victim.
