Abstract

in the context of jurisprudence muamalah, there are two terminology related to the law of engagement, namely akad and wa'ad (promise). The cleric agrees that the formation of transactions if the compensation of the agreement of the contract, namely harmonious and legal conditions of a contract. However, scholars differ on the law of wa'ad (promise) and muwâ'adah (mutual promise). The differences are background on the law of promise that is binding or non-binding in a transcation. In its implementation level, there are some DSN-MUI fatwas that pertain to the concept of wa'ad (promise). The conclusions show that; first, wa'ad is "Statement of the party / person (legal subject) to do / do nothing; and the deed is done in the future (istiqbâl) ". The scholars differ on the law of fulfilling wa'ad (the promise); second, in the context of the DSN-MUI fatwa, there are a number of fatwas related to the implementation of the concept of wa'ad, namely (1) Fatwa DSN-MUI Number: 4 / DSN-MUI / IV / 2000 on Murâbahah; (2) the DSN-MUI fatwa Number: 27 / DSN-MUI / III / 2002 on IMBT; (3) the DSN-MUI fatwa Number: 73 / DSN-MUI / XI / 2008 concerning MMQ; (4) fatwa of DSN-MUI Number; 55 / DSN-MUI / V / 2007 concerning PRKS; (5) fatwa of DSN-MUI Number 28 / DSN-MUI / III / 2002 concerning Sale of Currency Currency (Al-Sharf)
