Abstract

The new juvenile penal procedure code sets forth the opportunity for victim-offender reparation processes. The authors, however, lay the stress on the substantial lack of application of this policy. In this regard, they advance some tentative hypotheses on the underlying reasons for the present resistance to change and the development of new cultural models open to the guiding principles of restorative justice. At the same time, they point out the lack of formal and informal operational projects and procedures concerning mediation processes, on the basis of which empirical reflection might be constructed.
