Abstract

Abstract. The definition of endorsement is according to experts is support or advice. One of the online shops that has repeatedly used influencer endorsement services is @tie_dyehoeuse. Endorsement agreement is made through a feature on one of the chat media which is called by a direct message. The purpose of this research is to find out the the endorsement agreement through direct messages between the tie_dyehouse online shop and the endorser based on the analysis of fiqh muamalah and pasal 1320 KUHPerdata, This research uses a type of qualitative research with normative descriptive.  The results of this research are endorsement agreements made by the online shop @tie_dyehouse with RV. AK, and AS in the perspective of Islamic Law are the same as Ijarah al-'Amal the agreement does not have anything that conflicts with syara' as long as the product that is the object of endorsement does not violate the basic principles of muamalah, according to pasal 1320 KUHPerdata is considered valid and legally binding, because the parties to the agreement have fulfilled the legal requirements of the agreement in accordance with article 1320  KUHPerdata seen based on agreement, skill, a certain matter, and based on lawful causes. Abstrak. Pengertian endorsement itu sendiri menurut para ahli adalah dukungan atau saran. Salah satu Online Shop yang telah berulang kali memanfaatkan jasa endorsement influencer yaitu @tie_dyehoeuse. Kesepakatan endorsement dilakukan melalui fitur di salah satu media chatting yang disebut dengan dirrect message. Tujuan penelitian ini adalah utuk mengetahui bentuk dari perjanjian endorsement melalui direct message antara online shop tie_dyehouse dengan endorser berdasarkan analisis fiqh muamalah dan pasal 1320 KUH Perdata, penelitian ini menggunakan jenis penelitian kualitatif yang bersifat deskriptif normatif. Hasil penelitian ini menjelaskan perjanjian endorsement yang dilakukan oleh pihak online shop @tie_dyehouse dengan RV. AK, dan AS dalam perspektif Hukum Islam sama hal nya dengan Ijarah al-’Amal, perjanjian itu sendiri tidak terdapat hal yang bertentangan dengan syara’ selama produk yang menjadi objek endorsement tidak melanggar prinsip-prinsip dasar pada muamalah, menurut pasal 1320KUH Perdata pun dianggap sah dan mengikat secara hukum, karena para pihak yang melakukan perjanjian sudah memenuhi syarat sah perjanjian sesuai dengan pasal 1320KUH Perdata dilihat berdasarkan kesepakatan, kecakapan, suatu hal tertentu, dan berdasarkan sebab yang halal.
