Un nuevo tipo penal de femicidio en un nuevo Código Penal para Chile

Abstract

The goal of this paper is to make a clear proposal for a new formulation of the femicide's offence in Chile. In the first part, it will be clarified the importance to have a specific rule in the law in force in the country and it will be summarized the most important deficiencies of the Ley 20.480 of 2010, that introduced the new offence. In the second part, there will be investigated the bases for the change, looking at comparative law and at the drafts of 2005 and 2014 for a new penal code. In the third part, it will be offered the text of the proposal with an explanation of the taken decisions and the answers to hypothetical critiques.
