In the field of parental relations, family law cannot remain immune to the effects of civil liability. Based on the expressed content of article 229 of the Federal Constitution and the principle of family solidarity, parental responsibility overlaps the possible freedom of action of parents; grounded in the free family planning and in the best interest of the child and adolescent, the exercise of the duties of parental authority is imperative command whose failure - if and when generator of "moral abandonment∗∗∗ of the child or parental alienation syndrome - may be compensated by means of civil liability for non-economic losses.
