Abstract

The interest in mediation in the Grand Duchy of Luxembourg has increased with the entry into force of the Law of 24 December 2012 implementing Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters. Luxembourg decided to apply the new rules both to domestic and crossborder disputes. However, it is difficult to go beyond the text. The gap between the doctrinal and legislative discourse on mediation and the practical effectiveness of this alternative dispute resolution mechanism remains important in Luxembourg.
