Abstract

This articleintends todisseminatethe IslamiccriminallawinIndonesiain several ways: there are changingthe constitution, changing thenationallegal systembecamethe Islamic Law, Islamisationof national law, expandingReligious Court competencies, incorporating Islamiclawelementsof Jinayat inthe National Law, andmaximization of Regionalregulationbecame Islamic law. IslamicCriminal Law(jinayat) isnot developedby Indonesian jurists. Thisseemsa logical consequenceof missapplication in the Islamic countries, like Saudi Arabia, Yaman, and Iran.Islamiccriminal lawhas beenreplacedby the criminal lawfromthe West, for example,Britishcriminal law andNetherlands criminal law. Eventually, the obstacle of implementation of Islamic Criminal Law are the stronginfluence ofthe Dutchcriminal lawheritage, culturalobstacle, sosiological obstacle, and political obstacle
