Abstract

ABSTRAKTulisan ini dibuat bertujuan untuk mengetahui lebih dalam tentang sistem preferensi umum/Generalyzed System of Preferences (GSP). Pemberian tarif dan bea masuk oleh negara maju kepada negara berkembang seringkali dibarengi dengan motif-motif lain dalam pelaksanaannya di lapangan. Negara maju tidak serta merta memberikan fasilitas kemudahan perdagangan ini kepada negara-negara berkembang dalam menjual produk-produknya di pasar mereka. Dikarenakan pasal asli dalam aturan perdagangan internasional hanya mengatur secara umum. Pasal yang ada di dalam GATT tidak mengatur secara spesifik mengenai pemberian fasilitas kemudahan bea masuk (GSP). Artikel ini mencoba memasukkan pasal-pasal dalam konvensi-konvensi relevan terkait fasilitas GSP. Metode penelitian yang digunakan dalam penulisan ini ialah deskriptif analitis yang menggambarkan berbagai masalah hukum, fakta, serta gejala lainnya dengan metode pendekatan yuridis normatif yaitu bersifat memaparkan atau menggambarkan permasalahan-permasalahan yang ada dengan cara meneliti bahan hukum primer, literatur-literatur, artikel-artikel, pendapat para ahli. Dari hasil penelitian didapat mengenai pasal-pasal dalam konvensi-konvensi yang masih relevan dalam pemberian fasilitas bea masuk dalam sistem preferensi umum/Generalized System of Preferences (GSP) ialah Pasal 1 ayat 3 Piagam PBB, Resolusi Sidang Umum PBB tanggal 12 Desember 1974 [3281 (XXIX)] Piagam Hak-Hak Kewajiban Ekonomi Negara-Negara Pasal 18, 19, 21, 25 dan 26. Pasal-pasal yang disebut diatas masih relevan dalam kaitannya dengan sistem preferensi umum/Generalized System of Preferences (GSP). Kata Kunci: gsp, tarif, fasilitas, negara berkembang, negara maju. ABSTRACTThis paper aims to find out more about the Generalized System of Preferences (GSP). The provision of tariffs and import duties by developed countries to developing countries is often accompanied by other motives in their implementation in the field. Developed countries do not necessarily provide these trade facilities to developing countries in selling their products in their markets. Because the original article in international trade rules only regulates in general terms. The article in the GATT does not specifically regulate the provision of import duty facilities (GSP). This article tries to include articles in relevant conventions related to GSP facilities. The research method used in this paper is descriptive analytical which describes various legal issues, facts, and other symptoms using a normative juridical approach, which is to describe or describe existing problems by examining primary legal materials, literature, articles. , expert opinion. From the results of the research, it was found that articles in conventions that are still relevant in providing import duty facilities in the Generalized System of Preferences (GSP) are Article 1 paragraph 3 of the United Nations Charter, Resolution of the United Nations General Assembly dated December 12, 1974 [3281 (XXIX)] Charter of Economic Rights and Duties of States Articles 18, 19, 21, 25 and 26. The articles mentioned above are still relevant in the Generalized System of Preferences (GSP).Keywords: gsp, tariffs, facilities, developing countries, developed countries.
