The internet of things and intellectual property in the Russian legal system

Abstract

The article reviews legal regulation of the relation between intellectual property and IoT in terms of the development of the global IT infrastructure in the Russian Federation. The topicality of studied issues is determined by an urgent need to improve legislation in the IoT regulation related to solving the tasks stated in the government program entitled "Digital Economy". The purpose of the paper consists in outlining the principal guidelines of improvement of the legal mechanism that define the forms and methods of IoT application, and in establishing an effective legal framework of intellectual property for IoT introduction. The main approaches to the study hereof are dialectical, systemic, and interdisciplinary one, etc., which allow to make a comprehensive study of IoT conditionality when solving the tasks of the "Digital Economy" government program. Results in the chapter describe the current situation in IoT legal regulation and thereupon distinguished peculiar features of intellectual property application to solve the tasks of developing global IT infrastructure in the Russian Federation. In particular, we analyzed the mechanisms of using some intellectual property items in IoT and also outlined the guidelines to improve legislation herein. The article is of practical value for wide-skilled specialists working in the information and legal area, for academic researchers involved in the analysis of legal, information and economic aspects of the global IT infrastructure operation, as well as for people engaged in legislative activities.
