Quem é o imigrante? O direito europeu e a categorização das pessoas na União Europeia

Abstract

O que significa ser um imigrante e qual a linha do tempo desta categoria? Esta contribuição analisa tal pergunta a partir da perspectiva da União Europeia, onde os nacionais dos Estados-membros alteraram gradativamente o seu status de imigrantes para cidadãos da União Europeia, ao mesmo passo em que permaneciam firmemente nacionais de seus próprios países. A corrida da União Europeia em prol da regulamentação de outra forma de imigração, a dos nacionais de países fora da UE, remonta há apenas doze anos, mas já revela profundas tensões na construção da identidade e do pertencimento no espaço multinacional que é a Europa. Esta investigação levanta questões sobre o significado da cidadania e sua instrumentalização, obrigando-nos a pensar além do monopólio estatal sobre a identidade inerente à tradição weberiana.What does it mean to be a migrant and what timeline does the category have? This contribution examines the question from the perspective of the European Union where the nationals of the Member States have gradually changed their status from migrant to citizen of the European Union while at the same time fiercely remaining nationals of each of their own countries. The foray of the European Union into the regulation of migration in another form, that of nationals of countries outside the EU is only 12 years old but already it reveals deep tensions in the construction of identity and belonging in the multi-nation space which is Europe. This examination raises questions about the meaning of citizenship and its instrumentalisation which oblige us to think beyond the state monopoly over identity inherent in the Weberian tradition.
