Under which conditions does policy transfer through political conditionally lead to convergence? The comparison of non-discrimination and minority rights legislation in the applicant states of Central and Eastern Europe shows that the impact of EU conditionality depends on how explicitly the EU linked accession to the adoption of individual rules (strength of conditionality) and how precise and binding those rules were (clarity of conditions). In cases of strong conditionality, policy transfer was particularly fast and complete. Only when conditions were clear, however, did policy transfer through conditionality also result in convergent legislation in the accession countries. For this reason, convergence was higher in the case of nondiscrimination than with regard to minority rights.
