PENGATURAN PEMBERIAN PERS`ETUJUAN PRESIDEN TERHADAP RANCANGAN PERATURAN MENTERI BERDASARKAN TEORI PERATURAN PERUNDANG-UNDANGAN

Abstract

Abstrak Pengaturan Persetujuan Presiden terhadap Peraturan Menteri dilandasi oleh banyaknya peraturan menteri yang materi muatannya tumpang tindih dan tidak selaras dengan kebijakan Presiden. Akan tetapi Peraturan Presiden No. 68 Tahun 2021 ini menimbulkan masalah baru, yaitu memperpanjang rantai birokrasi dan mengintervensi perintah delegasi yang sudah diberikan. Berkaitan dengan latar belakang di atas terdapat beberapa persoalan yang akan diulas, antara lain: kedudukan Peraturan Menteri dalam sistem peraturan perundang-undangan di Indonesia; implikasi Persetujuan Presiden terhadap Rancangan Peraturan Menteri; dan konsep ideal pembentukan Peraturan Menteri. Hasil penelitian ini menunjukkan bahwa kedudukan Peraturan Menteri tidak termasuk ke dalam hierarki Peraturan Perundang-undangan sebagaimana dimaksud Pasal 7 ayat (1) UU Pembentukan Peraturan Perundang-undangan yang memberikan kesan ketidakjelasan kedudukan Peraturan Menteri. Selanjutnya berkaitan dengan jumlah dan disharmoni Peraturan Menteri, Peraturan Menteri merupakan bentuk peraturan paling banyak di antara jenis peraturan lainnya, dimungkinkan menciptakan kewenangan baru, memberikan hak dan kewajiban bagi masyarakat dan kerap melampaui batas hingga mencampuri kewenangan kementerian lain. Sehingga diperlukan upaya untuk menyelesaikan permasalahan ini, mulai dari mempertegas kedudukan Peraturan Menteri dan mengatur materi muatan Peraturan Menteri; memperjelas kriteria Peraturan Menteri yang harus disetujui, mengembalikan proses Pembuatan Peraturan Menteri seperti semula serta penegasan kewenangan yang didelegasikan tidak perlu diintervensi lagi.  Kata kunci: Persetujuan Presiden, Pengaturan Peraturan Menteri, Hierarki Perundang-undangan  Abstract The regulation of Presidential Approval on Ministerial Regulation is caused by hyper Ministerial Regulation whose content overlaps and is not in line with the President’s policy. However, Presidential Regulation No. 68/2021 raises new problems, such as extending the bureaucratic chain. Based on these, there are several issues that will be discussed, including: the position of the Ministerial Regulation in the Indonesian Law Making System; implications of the Presidential Approval on the Draft Ministerial Regulation; and what is the best way to create Ministerial Regulation. The results of this research indicates that the position of the Ministerial Regulation is not included in the hierarchy of Laws of the Republic of Indonesia based on Article 7 (1) of the Law of Law Making which gives the impression that the position of the Ministerial Regulation is unclear. Furthermore, it is related to the number and disharmony of Ministerial Regulations, where Ministerial Regulations are the hyper regulation among other types of regulations, it is possible to create new authorities, give rights and obligations to the citizens and often cross border the authority of other ministries. So that efforts are needed to solve this problem, start from confirming the position of the Ministerial Regulation to hierarchy of legislations strongly; clarifying the criteria for Ministerial Regulations that have to approved, restoring the process of making Ministerial Regulation as before and affirming that the delegated authority does not need to be intervened again.  Keywords: Presidential Approval, Ministerial Regulation, Hierarchy of Legislations
