Abstract

Legal aspects of alleged overfishing by the Restigouche Band regarding the Atlantic salmon (Salmo salar ) fishery in the Restigouche River, Canada are examined, discussing the aboriginal and treaty fishing rights claimed by the band. Several policy considerations are noted and elements of an Indian Atlantic salmon fishery policy that could lead to a resolution of the dispute are outlined.
