Abstract

Indonesian government has officially issued a policy of moving the State Capital from the Province of the Special Capital Region of Jakarta to Kalimantan Island. The policy has not yet determined the province that is formed for the capital city on the island of Kalimantan. The State Capital transfer policy is planned to be carried out starting in 2020. However, due to Covid-19, it seems that the transfer of State Capital cannot be carried out. Looking at the data on the website of the House of Representatives of the Republic of Indonesia (DPR RI), it appears that there is already a list of Draft Laws on State Capital that are included in the National Legislation Program (Prolegnas). This means that the State Capital transfer policy is really serious about being implemented. Based on some information, the State Capital plan will be based on a smart city. Of course, this is interesting considering that the world is currently leading to the development of a smart city-based region. But the question is whether the State Capital transfer policy is correct from a legal aspect, considering that the State Capital Law has not yet been formed? Then does the smart city-based State Capital transfer policy have an impact on ecology and social welfare? This article analyzes and answers that question. This article analyzes in depth related to the legal aspects of the State Capital transfer policy. This article also analyzes the impact of the State Capital transfer policy. The impacts to be analyzed in this article are ecological impacts and social welfare. The conclusions in this article are specific answers to the questions posed in this article.
