Abstract

The purpose of this study was to determine the legal standing of the 1929 Deed in the application for land rights and the legal protection of the Pakel Village Community's land rights against PT. Bumi Sari. To help analyze this research, legal research of the normative juridical type is used, accompanied by qualitative methods. Based on the description of the discussion, it was concluded that the Deed of 1929 belonged to 800 families of the Pakel Village community, namely the land clearing rights (Ontginningsrecht), which could be used as the basis for applications for land conversion and registration. The reason for giving communal ownership rights is because the land has been cultivated together for almost a century without interruption. This document can be used as a proof of title document and a starting point for land registration applications for residents, especially the portion of land that has been claimed by PT. Bumi Sari and is included in the company's HGU concession. The legal protection that the Pakel community can seek is by filing civil lawsuits and state administration lawsuits. In addition, non-litigation efforts such as mediation, forming a special team, and providing appropriate compensation or relocation.   Tujuan dari penelitian ini adalah untuk mengetahui kedudukan hukum Akta 1929 dalam permohonan hak atas tanah dan Perlindungan Hukum hak tanah masyarakat desa Pakel terhadap penguasaan tanah PT. Bumi Sari Untuk membantu menganalisis penelitian ini, digunakan penelitian hukum kepustakaan berjenis yuridis normatif disertai dengan metode kualitatif. Berdasarkan uraian pembahasan, dihasilkan bahwa Akta 1929 milik 800 KK masyarakat desa Pakel, yaitu hak pembukaan tanah (Ontginningsrecht) yang dapat dijadikan dasar permohonan konversi dan pendaftaran tanah. Alasan diberikannya hak milik komunal sebab tanah telah digarap bersama selama hampir 1 abad tanpa gangguan. Dokumen ini dapat dijadikan sebagai dokumen pembuktian hak dan menjadi petunjuk awal permohonan pendaftaran tanah bagi warga, khususnya bagian atas tanah yang sejak 1985 diklaim oleh PT. Bumi Sari masuk ke dalam konsesi HGU perusahaan. Perlindungan hukum yang dapat diupayakan masyarakat Pakel adalah dengan mengajukan gugatan perdata dan gugatan TUN. Selain itu, upaya non litigasi seperti mediasi, pembentukan tim khusus dan pemberian ganti kerugian/relokasi yang layak.
