Abstract

Seni ukir khas Toraja merupakan karya cipta yang memiliki potensi perlindungan Hak kekayaan Intelektual (HKI) khususnya perlindungan indikasi asal. Suatu bentuk perlindungan yang masih jarang dilakukan di Indonesia. Penelitian ini bertujuan untuk mengetahui: 1) upaya masyarakat Tana Toraja dalam upaya melindungi seni ukir Toraja; 2) penerapan perlindungan indikasi asal atas seni ukir khas Toraja. Metode penelitian yang digunakan adalah penelitian yuridis empiris, hasil penelitian menunjukkan bahwa 1) upaya masyarakat Toraja dalam melindungi seni ukir khas Toraja itu dengan jalan memperkuat peran pemerintah dalam mendorong kampanye/sosialisasi dalam pelestarian, juga pembinaan langsung ke masyarakat pengukir. Adapan masyarakat umum dilakukan dalam bentuk peningkatan rasa memiliki kebanggaan atas warisan yang perlu dilestarikan dan mengisinya dalam bentuk pameran-pameran dan even-even penting. 2) bentuk perlindungan indikasi asal atas seni ukir Toraja belum terselenggara disebabkan belum terdapatnya kesamaan paham pemerintah tentang konsepsi berkenaan dengan Indikasi Asal, Dengan demikian kegiatan mengakategorikan ke dalam indikasi geografis tidak dilakukan dan berdasarkan prinsip Indikasi Asal suatu produk harus didaftarkan, dan pendaftaran itu tidak dilakukan. Toraja carving art is a copyrighted work that has the potential to protect Intellectual Property Rights (IPR), especially the protection of indications of origin. A form of protection that is still rarely carried out in Indonesia. This study aims to determine: 1) the efforts of the people of Tana Toraja in an effort to protect the art of Toraja carving; 2) the application of protection for indications of origin for the typical Toraja carving art. The research method used is empirical juridical research, the results of the study show that 1) the efforts of the Toraja people to protect the typical Toraja carving art by strengthening the government's role in encouraging campaigns/socialization in preservation, as well as direct guidance to the carving community. Adapan for the general public is carried out in the form of increasing a sense of pride in the heritage that needs to be preserved and filling it in the form of exhibitions and important events. 2) the form of protection for indications of origin for the Toraja carving art has not been implemented due to the absence of a common understanding of the government regarding the conception regarding indications of origin, thus the activity of categorizing into geographical indications is not carried out and based on the principle of indications of origin a product must be registered, and registration is not carried out.
