Abstract

Land acquisition for the implementation of development in the public interest is currently increasing along with and in line with the progress and dynamics of society, both in urban and rural areas. The government's authority to conduct land acquisition for public purposes is based on the principle that all land rights have a social function. Based on this, land acquisition for the public interest, especially for toll roads, is made possible by the state. This research discusses legal certainty of process and the correct implementation of compensation in land acquisition for public interest, especially for toll roads. This research is a normative law research with statute approach. The result of the research shows that in the implementation of land acquisition, it is necessary to have compensation and is the most important element. Compensation cannot be done arbitrarily. However, it still must reflect legal certainty so that there is clarity on procedures related to the basis for payment of compensation in the land acquisition process. This research finds that there are already provisions for establishing a land acquisition process and a compensation process that must be carried out by various parties. Bahasa Indonesia Abstrak: Pengadaan tanah bagi pelaksanaan pembangunan untuk kepentingan umum pada dewasa ini semakin meningkat seiring dan sejalan dengan kemajuan dan dinamisasi masyarakat, baik di perkotaan maupun pedesaan. Kewenangan Pemerintah untuk melakukan pengadaan tanah untuk kepentingan umum didasarkan pada asas bahwa semua hak atas tanah berfungsi sosial. Berdasarkan hal tersebut, maka pengadaan tanah bagi kepentingan umum khususnya bagi jalan tol sangat dimungkinkan oleh negara. Penelitian ini membahas mengenai kepastian hukum proses dan pelaksanaan yang seharusnya dilaksanakan di dalam penggantian kerugian dalam pengadaan tanah untuk kepentingan umum khususnya bagi pembangunan jalan tol. Penelitian hukum ini adalah penelitian hukum normatif dengan pendekatan pendekatan undang-undang. Hasil penelitian menunjukan bahwa di dalam pelaksanaan pengadaan tanah tersebut perlu adanya ganti kerugian dan menjadi unsur terpenting. Ganti kerugian tidak bisa dilakukan secara semena-mena. Namun tetap harus mencerminkan adanya kepastian hukum sehingga terdapat kejelasan prosedur terkait dasar pembayaran ganti kerugian dalam proses pengadaan tanah. Penelitian ini menemukan bahwa sudah adanya ketentuan penetapan proses pengadaan tanah dan proses ganti kerugian yang harus dilakukan oleh berbagai pihak.
