The present study provides a critical analysis about the policies and some specific practices from the Chilean Constitutional Court’s criminal jurisprudence from the Constitutional Reform Act 2005. Unfortunately, the principal feature of the Chilean Constitutional Court’s criminal jurisprudence lies in the lack of minimal protection demanded to any Constitutional Court. As an urgent call to changes, this analysis then puts forward a number of recommendations to amending criminal case law in Chile.
