Abstract

After the "timidity" of the courts under fascism, the postwar constitution gave great independence to the courts. Judges, including in the ordinary courts, "conjure novel interpretation of the laws to fit their own views..." They have a specialized constitutional court, which has been criticized for exceeding its authority in its exercise of judicial review.
