ANALISIS HUKUM TERHADAP PROSES KLAIM SANTUNAN ATAS KORBAN KECELAKAAN LALU LINTAS OLEH PERUSAHAAN ASURANSI (STUDI PADA PT JASA RAHARJA PERSERO)

Abstract

The research objectives are to analyze 1) the legal relationship between the heirs/victims and PT Jasa Raharja; 2) the process of claiming compensation for victims of traffic accidents carried out by PT Jasa Raharja; and 3) what are the factors that hinder the claim for compensation for traffic accidents by PT Jasa Raharja. This study uses a qualitative research with a normative-applied approach. The resource persons consisted of 1 person from PT Jasa Raharja and 2 patients/patient families. Based on the results of the study, it can be concluded that the legal relationship between the heirs/victims and PT Jasa Raharja as bound in a civil relationship in the form of rights and obligations of each party. Compensation claims for victims of traffic accidents carried out by PT Jasa Raharja are submitted by victims/heirs of the victims by filling out the compensation application form. And finally, the factors that hinder the claim for traffic accident compensation by PT Jasa Raharja are the premium payments are not in accordance with the provisions, the insured often delays in reporting claims, the patient's family does not meet some of the requirements specified in the claim submission, treatment due to traffic accidents carried out in traditional places and the victims or heirs are still many who do not know their obligations in fulfilling the requirements letter for submitting traffic accident compensation funds
