Abstract

This chapter describes the international patent and plant variety rights systems which are regulated by the Trade Organization (WTO) Agreement on Trade Related Aspects of Intellectual property Rights (TRIPS) and the International Convention for the Protection of New Varieties of Plants (UPOV). It looks at the jurisprudence around plant and DNA patenting and plant breeding. The chapter also looks at the impact upon agricultural innovation of the International Treaty for Plant Genetic Resources for Food and Agriculture.
