PROBLEMATIKA UNDANG-UNDANG NOMOR 11 TAHUN 2020 TENTANG CIPTA KERJA TERHADAP PEMENUHAN HAK ATAS INFORMASI LINGKUNGAN HIDUP

Abstract

ABSTRAKHak atas informasi lingkungan hidup merupakan salah satu hak asasi manusia, yang memberikan konsekuensi pada Negara untuk menghormati, melindungi, dan memenuhi hak itu. Penelitian ini mengambil permasalahan mengenai implikasi Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terhadap akses informasi lingkungan hidup bagi setiap orang. Penelitian ini merupakan penelitian normatif, dengan teknik pengumpulan data dilakukan dengan studi pustaka. Hasil penelitian menunjukkan bahwa setelah Undang-Undang Cipta Kerja disahkan oleh Presiden bersama DPR dan berlaku di Indonesia, ketentuan tentang akses informasi lingkungan hidup mengalami kemunduran, padahal informasi ini sangat penting bagi setiap orang untuk mengaktualisasikan peran sertanya dalam perlindungan dan pengelolaan lingkungan hidup. Ketentuan akses terhadap informasi lingkungan hidup dalam Undang-Undang Cipta Kerja hanya mengatur cara informasi itu diumumkan, yaitu melalui sistem elektronik atau cara lain.Kata kunci: hak atas informasi lingkungan hidup; problematika uu cipta kerja.ABSTRACTGetting environmental information is a human right, which has consequences for the State to respect, protect, and fulfill it. This research discusses the problems found in the implications of Law No. 11 of 2020 on Job Creation on access to environmental information for everyone. This research uses a normative research method, while the data collection technique uses a literature study. The research results show that the Job Creation Law ratified by the President and the House of Representatives and implemented into force in Indonesia has changed the provisions regarding access to environmental information. This situation has consequences for fulfilling this right since this information is very important for everyone to actualize their participation in protecting and managing the environment. Prior to the existence of the Job Creation Law, the right to environmental information has not yet been fully realized as mandated in Law No. 32 of 2009. Provisions for access to environmental information in the Job Creation Law only regulate how the information is announced through an electronic system or other media.Keywords: fulfilment right to environmental information; problems of job creation law
